Fake News Or Censorship? Bombay High Court's Split Judgment On IT Rules

In a split judgement on petitions challenging the amended Information Technology (IT) Rules on fake news, one judge of the Bombay High Court on Wednesday held that they amounted to censorship, while the other judge said the Rules do not have any chilling effect on free speech.

A division bench of Justices Gautam Patel and Neela Gokhale delivered different judgements, necessitating the placing of the petitions before a third judge. Patel struck down the Rules in question, terming them as unconstitutional, while Gokhale dismissed the petitions.

The matter would be put before the Chief Justice of the HC to be assigned to a third judge, the division bench said.

"There is a disagreement between us. I have held for the petitions and Justice Gokhale has held for the government. So now the matter will be heard afresh by a third judge," Justice Patel said.

Solicitor General Tushar Mehta agreed to extend for ten days an earlier assurance that until the judgment was delivered, the government would not notify the Fact Checking Unit (FCU) to be set up under the Rules to flag fake news about government on social media.

Under the Rules, if the FCU comes across or is informed about any posts pertaining to the business of the government that are fake, false, and contain misleading facts, then it would flag off the same to social media intermediaries.

The intermediary has the option of either taking down the post or putting a disclaimer on it. In the second option, the intermediary loses its safe harbour/ immunity and stands liable for legal action.

Patel held that no fundamental right says that every citizen has to receive only "true and accurate information as determined by the government".

Gokhale, on the other hand, held the right to share fake or untrue information was not part of the free speech right.

"Right of speech will not enjoy protection if the user knowingly and intentionally shares fake or misleading information, flagged albeit by a FCU...," she said.

Patel noted that the FCU would be "the sole authority to decide what piece of user-content relating to the undefined and unknowable business of the government is or is not fake." "How the FCU will go about its business is also unknown....Who, after all, is to fact-check the fact checker?...Quis custodiet ipsos custodes (Who will guard the guards)?"he asked.

"It is not the business of the government to keep citizens from falling into error. It is other way around...it is very much business and should be the duty of every citizen to prevent the government from falling into error," he said, adding that every attempt to whittle down a fundamental right must be resisted.

Justice Gokhale held that the Rules were not violative of any fundamental rights, nor did they suffer from arbitrariness.

The Rules, in fact, encourage discussion and dissemination of information on facts bereft of fakery, she said.

"No content is restrained by the impugned Rule, unless the content is patently false, untrue and is communicated with actual malice that is with knowledge of its falsehood and with reckless disregard for the truth and is deceptively passed off as a statement of truth," she said.

"The right to free expression is a crucial and indispensable component of a nation having adopted democracy. However, this right does not permit freedom to share information which a person knows to be false yet intentionally communicates as authentic," Gokhale said.

Justice Patel held that the State cannot coercively classify speech as true or false and compel non-publication of the latter, as this was nothing but "censorship".

He had the greatest difficulty in accepting the proposition that the government has an overriding authority to arrive at an absolutist determination of a content or expression as the truth, the judge said.

"There are no guidelines, no procedure for hearing, no opportunity to counter the case that some information is fake, false or misleading.... the Rules clearly make the Central Government a judge in its own cause.

Gokhale, however, noted that the Rules provide an opportunity to the intermediary to put a disclaimer on the content, and the FCU was merely tasked with identifying information concerning any business related to the government.

"The Rules does not in any manner, confer any authority on the FCU to direct the intermediary to take down any such information. It is left entirely to the discretion of the intermediary to make reasonable effort so that the user is encouraged not to continue to post, share etc. such information," she said.

She further said there was also a redressal mechanism for the intermediary as well as the user, and ultimately it is the court of law which would be the final arbiter. FCU cannot be presumed to be biased only because the power to notify is vested in the government, she added.

Members of the FCU would be those who are privy to the business or policies of the government, having access to authentic information to authoritatively determine any information as fake, and hence the FCU cannot be termed as biased, Justice Gokhale said.

Patel noted that one fully government-controlled entity, Press Information Bureau, is active and already has significant social media presence.

"The sinister and insidious facet to the impugned amendment is that this new agency (FCU) has far more than a loud bark: it has fangs and claws, for its unilateral view of what is or is not the 'truth' is accompanied by a requirement of removal of what is has so determined (to be fake, false or misleading)," he said.

Stand-up comedian Kunal Kamra, the Editors Guild of India, and Association of Indian Magazines filed petitions in the HC against the Rules, terming them arbitrary and unconstitutional and claiming that they would have a chilling effect on the fundamental rights of citizens.

On April 6, 2023, the Union government promulgated amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, including a provision for a fact-checking unit.

"Hanuman Was A Big Diplomat": S Jaishankar Finds Familiar Ground In Ramayan

Foreign minister S Jaishankar today found a Ramayana reference to his job -- and an epic  diplomat. In an exclusive, wide-ranging  interview with NDTV Editor-in-Chief Sanjay Pugalia, Mr Jaishankar spoke of finding examples in the Indian context for things instead of borrowing from the west.

In this context, he said even his job was featured in the great epic Ramayan.

"Hanuman was big diplomat. An actual diplomat, since he was sent to Lanka as an envoy," he told NDTV.

"Hanuman also had an intelligence mission. He had to gain information on Sita. And he was also an activist diplomat, since on his way out, he caused them great loss," Mr Jaishankar said, referring to the burning of Lanka, the capital of the demon king Ravan, who had abducted SIta.

He also spoke of the diplomatic tactics and mind games that Hanuman had employed while in the audience hall of Ravan.

"He managed to sit on a higher seat than the king and his ministers, which put them at a psychological disadvantage," Mr Jaishankar said, pointing out that so much of it is relevant even today.

Speaking at a news conference in Delhi after an all-party meet on the eve of the session, Sena MP Rahul Shewale also demanded that Parliament pass a resolution congratulating Prime Minister Narendra Modi for the construction of the Ram temple in Ayodhya.

Shewale, the Sena's leader in the Lok Sabha, said as the session would be the last session before the general elections, a bill on Uniform Civil Code should be passed.

"A resolution congratulating Prime minister Narendra Modi should be passed in Parliament for building a grand Ram temple, and all parties should back it," he added.

His party will support all the bills that the government will introduce, Shewale said.

The budget session will be a short session this time, between January 31 and February 9, with Finance Minister Nirmala Sitharaman set to table an interim budget ahead of the Lok Sabha polls. The new government will present the full-fledged budget.

Top Court Orders Courts To Shun Practice Of Mentioning Litigants' Caste

The Supreme Court has ordered its Registry, all High Courts, and subordinate courts to stop the practice of mentioning the caste or religion of litigants in case papers.

A bench of Justices Hima Kohli and Ahsanuddin Amanullah, in its recent order, said that the practice should be shunned and stopped immediately.

It directed all High Courts to ensure that the caste or religion of a litigant does not appear in the memo of parties in any petition filed before High Courts or subordinate courts under their jurisdiction.

"We see no reason for mentioning the caste/religion of any litigant either before this Court or the courts below. Such a practice is to be shunned and must be ceased forthwith. It is therefore deemed appropriate to pass a general order directing that henceforth the caste or religion of parties shall not be mentioned in the memo of parties of a petition/proceeding filed before this Court, irrespective of whether any such details have been furnished before the courts below," the bench stated in it's order.

The order of the top court came while allowing a transfer petition in a marital dispute pending before a family court in Rajasthan.

The top court, while permitting the transfer of the case to a family court in Punjab, was surprised to find that the caste of both parties to the dispute (husband and wife) had been mentioned in the memo of the parties.

No Disrespect: Tamil Nadu Governor Clarifies Speech Involving Gandhi

Tamil Nadu Governor R N Ravi on Saturday said he didn't disrespect Mahatma Gandhi while speaking on India's Independence struggle and asserted that the Father of the Nation has been the guiding light of his life.

Some media reports in the last three-four days sought to create "an erroneous impression" that he has been "disrespectful" to Mahatma Gandhi but nothing could be farther from the truth, he said.

"I hold Mahatma Gandhi, the Father of the Nation, in the highest regard and his teachings have been the ideals of my life," the Governor stated.

His clarification comes in the wake of the agitation by the TNCC members held here earlier in the day condemning the Governor for allegedly insulting the Mahatma and belittling his role in the freedom struggle.

TNCC chief K S Alagiri, Su Thirunavukkarasar, MP, and Congress Legislature Party leader K Selvaperunthagai, were among those who participated in the agitation.

"I did not mean any disrespect to Mahatma Gandhi whose teachings have been the guiding light of my life," a Raj Bhavan communique quoting Ravi said referring to his speech at the 127th birth anniversary of Netaji Subhas Chandra Bose on January 23, here.

Some media "did cherry-pick" from the speech and "gave it a twist," he said. "In my speech, I sought to elaborate the point that Netaji's significant contributions to our nation's Independence has not been adequately appreciated. I tried to make a point that what accelerated the pace and process of Independence in 1947 were the revolts of the Royal Indian Navy and Air Force in February 1946 – both inspired by Netaji," the Governor said.

Due to these revolts, the British panicked as they could no longer trust the Indians in uniform for their own safety and security in India. Following the February revolts, in March the British publicly declared that they would leave India and constituted the Constituent Assembly to demonstrate their sincerity, assuage the feelings of the agitated Indians and pre-empt potential revolts which could have had existential consequences for the British officers and their families in India.

The Naval and Air Force revolts were greatly inspired by the revolutionary actions of Netaji including the war of the Indian National Army against the British, he said.

The Quit India Movement of August 1942, after initial success had lost steam. Internecine conflicts in the National Freedom Movement due to the Muslim League's vehement insistence on the partition of India and its reactions on the ground kept much of the efforts and energy of the Congress leaders on how to manage the internal conflicts, much to the delight of the British.

"The British could have ruled India for some more years but for Netaji's armed revolution and its domino effect on the Indian Military and Security Forces. What I have said are facts based on primary documents," Ravi stated.

"Congress Like Ocean, Unaffected": DK Shivakumar On Jagdish Shettar's Exit

After former Karnataka Chief Minister Jagadish Shettar returned to the BJP barely months after joining Congress, Deputy Chief Minister DK Shivakumar on Friday likened the Congress to an ocean and said that the exit of one individual does not make any difference to the party.

Speaking to reporters at the KPCC office, he said, "The Congress party is an ocean. It stays unaffected irrespective of anyone joining or leaving. Many people are looking forward to joining Congress too."

DK Shivakumar further claimed that despite the BJP trying to establish contact with him for the last 2-3 months, Mr Shettar was determined to stay in the party for a couple of days.

"Jagadish Shettar had joined the Congress after his disillusionment with the internal affairs of the BJP. He had even made big accusations against the BJP. We had accommodated him as an MLC despite his loss by 35,000 votes in the last assembly elections. Despite the BJP trying to establish contact with him for the last 2-3 months, Mr Shettar was determined to stay in the party till a couple of days," he said.

"We had accommodated him with a long-term view. Congress party leaders and workers from the Belagavi district are happy about his exit. The MLC seat that is vacated after his exit will be given to a loyal party worker," he added.

Asked if the Congress party will take in only those who come based on ideology, he said, "Anything can happen in politics. We had supported the JDS to keep the BJP away. But today he has joined hands with the BJP, which brought down his government. Both JDS and Kumaraswamy are working as spokespersons of the BJP today. Everyone knows the language Kumaraswamy used against the BJP when his government was brought down. Today's politics is shameful. Power comes and goes but we need to do clean politics."

Referring to AICC President Mallikarjun Kharge's comments that the party should induct only those who are aligned with the party ideology, Shivakumar said, "We will certainly follow the instructions of our senior leaders."

On being asked if the BJP would try to bring down the Congress government in the state post the Lok Sabha elections, the Deputy Chief Minister said, "The BJP may be in that situation post the elections. I don't think anything will happen to the Congress government."

Yogi Adityanath Forms High-Level Committee To Manage Ram Temple

Following the Pran Pratishtha ceremony of Ram Lalla at the Shri Ram Janmabhoomi temple, Ayodhya was witnessing a significant surge in visitors.

A high-level committee has been established on the instructions of Chief Minister Yogi Adityanath, who is overseeing the arrangements for the smooth darshan of Ram Lalla and the overall management of the Shri Ram Janmabhoomi temple.

The committee, led by Uttar Pradesh Government's Transport Minister Dayashankar Singh, includes the Chief Secretary, DGP, Additional Chief Secretary to the Chief Minister, and the Principal Secretary of the Urban Development Department.

Since the temple's inauguration, Chief Minister Yogi Adityanath's efforts, aimed at ensuring the convenience of Lord Ram devotees, are beginning to yield positive results.

Under the supervision of the high-level committee, the administration and police forces are actively engaged in enhancing the system.

The crowd situation has notably improved due to Chief Minister Yogi Adityanath's direct involvement at Ground Zero.

Following discussions with the administration and the temple trust, his instructions led to over 5 lakh devotees experiencing hassle-free darshan on Tuesday and approximately 2.5 lakh on Wednesday. On Thursday, visitors encountered no issues in the darshan.

Post the Pran Pratistha ceremony, a significant number of Lord Ram devotees from across the country are arriving in Ayodhya for Ram Lalla's darshan.

In the first two days alone, around 8 lakh devotees had the privilege of darshan.

Concurrently, in line with Chief Minister Yogi Adityanath's directives, the district administration and police forces are actively organizing the departure of returning devotees in an orderly manner. Furthermore, new devotees arriving are also being provided easy darshan.

Gyanvapi Petitioners Make Survey Report Public, Claim Temple Existed

The survey of the Gyanvapi mosque has revealed the existence of a temple, complete with 34 inscriptions in various languages, which was remodelled into a mosque, the lawyer of the Hindu petitioners told the media today after receiving a hard copy of the survey report. The Varanasi district judge had earlier refused to make the report public immediately or distribute soft copies to avoid any distortion and spread of misinformation on social media in view of the sensitivity of the case.

Gyanvapi is one of the several temple-mosque disputes that mushroomed in the country after the Ayodhya Ram Janambhoomi issue. The ASI report - submitted a month ago in a sealed cover -- was distributed days after the consecration of the Ayodhya temple at a mega programme led by Prime Minister Narendra Modi.

Late this evening, Vishnu Jain, the lawyer for the petitioners, read excerpts from the report at a press conference. The Archaeological Survey of India, during its survey, found a "pre-existing structure and a well next to the corridor".

The "Central chamber and the main entrance have a pre-existing structure."

The ASI, in its survey, "Studied the pillars and plasters and said all were part of the temple," said Mr Jain, while reading out the ASI report.

"34 inscriptions of Hindu temple were found and the inscriptions are in Devnagri, Granth, Telugu and Kannada. Names of deities Janaradana, Rudra and Umeshwara are found in inscriptions."

Reading from the report, he said, 'Terms such as Maha Mukti Mandap are mentioned in inscriptions... pillars from an earlier temple were reused while making cellars." The petitioners' lawyer has said that they will ask for an ASI survey of Wazukhana.

The ASI had been surveying since August 4 last year on the Gyanvapi mosque premises. It has only left out the Wazukhana area, which was sealed by the order of the Supreme Court.

The report is crucial to the decision in the case, in which the Hindu side contends the mosque has been built over a temple and demands the right to worship.

"Drones Becoming Weapon Of Choice For...": Air Force Chief To NDTV

Drones are becoming the weapon of choice for state and non-state actors, Air Chief Marshal VR Choudhary told NDTV in an exclusive interview.

The Indian Air Force (IAF) is looking at using drones not only for reconnaissance, but also for strike roles, the Air Chief Marshal said.

"Drones are now becoming a weapon of choice of both state and non-state actors. And we also realised the potential of inducting drones in large numbers, not only for recce and surveillance, which were the traditional roles for which we use them, but also for certain offensive missions," Air Chief Marshal Choudhary told NDTV.

With drones becoming mainstream in offensive roles, air-defence capabilities will also have to be improved, he said. The war in Ukraine has shown the effectiveness of drones, and how the much cheaper hardware can destroy larger, more expensive targets.

"... While the proliferation of drones takes place in the subcontinent, we have a plan to boost our air defence capabilities because now we have a huge spectrum of threats, starting from small drones to hypersonic weapons. So the air defence network and capabilities need to be strengthened in equal measure," Air Chief Marshal Choudhary said.

The Air Chief Marshal briefly explained the process that India has been following in developing drones of all types, from basic to complex machines, involving the Defence Research and Development Organisation (DRDO) and small private firms.

He pointed to the "Mehar Baba Competition" by the IAF for Indian start-ups to develop a swarm drone-based system.

"We got astonishing results from the Mehar Baba Competition, and incubated many small firms. Many small industries that started making drones in swarms have been able to meet the requirements that we had projected at that time," Air Chief Marshal Choudhary said.

"I think this industry is really galloping within our country, and most of it is in the private sector and small scale, and we encourage all of them to come up with their ideas and see how we can implement them in our broader operational plans," he said.

"For bigger platforms that can fly high and have long endurance, we are collaborating with other industries to be able to make a long-term plan for homegrown capability in this field. So the whole drone ecosystem is being supported and encouraged by the armed forces, particularly by the IAF," Air Chief Marshal Choudhary said.

Masala Tea At Shop, UPI Payment, Roadshow: When PM, Macron Met

Prime Minister Narendra Modi and French President Emmanuel Macron took part Thursday in a roadshow in the Pink City, where the visitor was presented a replica of Ayodhya's Ram temple and offered masala chai from a teashop before the leaders sat down for bilateral talks.

Macron, who is the chief guest at the Republic Day celebrations in Delhi on January 26, also visited the hilltop Amber Palace, Jantar Mantar observatory and Hawa Mahal in a carefully curated tour that ended at an iconic palace-turned-hotel.

In the evening, the two leaders were driven in an open-top vehicle through a short stretch in the heart of the city, beginning from Jantar Mantar, the 18th century astronomical observatory which is now a Unesco heritage site.

Latest and Breaking News on NDTV

They stood in the vehicle, chatting and waving at people who lined the route.

For the PM, it was the first visit to the city after the swearing-in of Bhajanlal Sharma who took over as the Rajasthan chief minister after the BJP victory in the recent assembly polls.

PM Modi and Macron got down in front of the breezy Hawa Mahal. They admired the lit-up five-storey building with nearly 1,000 windows and 'jharokhas'.

The two leaders visited a handicrafts shop in the area. PM Modi, who led the consecration ceremony at Ayodhya's new Ram Mandir this week, bought a small replica of the temple for the guest, according to the shopkeeper.

Latest and Breaking News on NDTV

He paid Rs 500 for the artifact -- digitally, through UPI.

And "Sahu chaiwala", who had set up a temporary stall for the occasion, accepted Rs 2 as token payment for the masala tea offered to the leaders. Again, the payment was digital.

The two leaders boarded the open-top vehicle again to continue the roadshow up to Sanganeri Gate. From there, they were to be driven to Rambagh Palace for dinner and the bilateral talks.

Latest and Breaking News on NDTV

Earlier, in the afternoon, the French delegation was received by External Affairs Minister S Jaishankar, Rajasthan Governor Kalraj Mishra and Chief Minister Bhajanlal Sharma at the Jaipur airport.

A couple of hours later, PM Modi, who was on a visit to Uttar Pradesh's Bulandshahr, also reached Jaipur. He met up with Macron at Jantar Mantar, where the two shook hands, hugged and then took a brief tour of the observatory.

Before this meeting, Macron had already ticked off Amber Palace on his Jaipur itinerary. His delegation had headed straight from the airport to the fort, the seat of Kachhwa Rajputs before Jaipur was founded nearby.

A red carpet was laid out and caparisoned elephants lined up at the fort for the French president.

Macron interacted there with a group of children. The delegation also browsed through artifacts on display at the temporary stalls set up near the entrance.

S Jaishankar and Rajasthan Deputy Chief Minister Diya Kumari were at the fort.

Cutouts and hoardings were earlier put up at several locations in Jaipur around the sites PM Modi and Macron were set to visit.

Anti Terror Agency Files Fresh Chargesheet Against 2 In Coimbatore Car Blast

The NIA on Wednesday filed a fresh charge sheet and named two more accused in the ISIS-inspired Coimbatore car bomb blast case of 2022, an agency spokesperson said.

Mohammed Azarudeen alias Azar and Mohammed Idris, both residents of Coimbatore, have been named in the supplementary charge sheet and have been charged under various sections of the Indian Penal Code, Unlawful Activities Prevention Act (UAPA) and Explosive Substances Act, the spokesperson said.

With this, a total of 13 people have been charge-sheeted in this case till now. The rest were named in the prosecution complaints filed by the National Investigation Agency (NIA) in April and June last year.

The probe pertains to an explosion that took place in front of the ancient Arulmigu Kottai Sangameshwarar Thirukovil Temple at Eswaran Kovil Street in Ukkadam, Coimbatore on October 23, 2022, through a vehicle-borne improvised explosive device (VBIED), allegedly driven by one Jamesha Mubeen.

Mubeen was "inspired" by hardcore ISIS ideology to commit this act of terror.

The NIA probe found, the spokesperson said, that Mubeen, along with Mohammed Azarudeen, Umar Faaruq, Sheikh Hidayathullah and Sanofer Ali, conspired to carry out a series of suicidal terror attacks in Coimbatore city following a conspiracy hatched in the forested area of Sathyamangalam region in Erode district of Tamil Nadu.

The attack was intended to wreak vengeance on 'kafirs' (non-believers), as stated in one of the self-made confessional videos by the accused a few days before the attack, the spokesperson said.

Azarudeen, who acted as a pedagogue to the module involved in the attack, was earlier arrested by the NIA in another case related to the indoctrination of ISIS ideology and in connection with the NTJ (National Thowheeth Jama'ath) module of Sri Lanka, which was responsible for the 2019 Easter blast attacks in the island country.

"Azarudeen had motivated three other accused who met him in the high-security prison (HSP) Viyyur. This led to the subsequent Sathyamangalam Conspiracy meeting, resulting in the planning and preparation of the instant terror attack," the spokesperson added.

Accused Umar Faaruq was elected as the "Amir" to lead the execution.

Mohammed Idris, part of the module of Azarudeen and radicalised in the ISIS and by the 'bayans' (statements) of accused Zahran Hashim, was tasked with purchasing a used vehicle for the blast and to assisting the main accused in the attack, he said.

"The larger aim of the conspiracy was to create terror in the minds of a section of the society by targeting its various branches like general administration, police, judiciary," the spokesperson said.

Security Tightened In Imphal As Manipur Ministers To Meet This Key Group

Security has been tightened in and around Manipur capital Imphal after Arambai Tenggol asked all ministers and MLAs from the valley districts for a meeting at Kangla Fort on Wednesday.

Arambai Tenggol, an organisation of around 50,000 people engaged in guarding villages in the valley areas of the state, has asked all ministers and MLAs from the valley districts to come for discussions, the details of which have not been specified, an official said, adding "there are intel reports that they (Arambai Tenggol) are planning to enter Kangla fort with arms before the meeting."

According to the officials, a large number of security forces including CRPF, Assam Rifles, Army and state police have been deployed near the fort as a precautionary measure.

Kangla Fort served as the royal seat of Manipur kingdom till 1891.

Earlier too, Arambai Tenggol had asked all legislators to attend a meeting at Kangla Fort, the official said.

The development comes a day after a three-member Union home ministry team met the leaders of the group at the residence of Rajya Sabha MP Leishemba Sanajaoba on Monday, the official added.

The group has demanded delisting of Kukis from the ST list, deportation of refugees to camps in Mizoram, border fencing, replacement of Assam Rifles with other paramilitary force and revoking Suspension of Operations (SoO) agreement between Centre and Kuki militant groups, officials said.

The central team included former Intelligence Bureau special director AK Mishra, SIB New Delhi joint director Mandeep Singh and SIB Imphal joint director Rajesh Kamble.

Rajasthan Minister's One-Meal Vow Until Grand Krishna Temple Is Built

Rajasthan Education Minister Madan Dilawar on Monday said he will eat only one meal a day till a grand temple is constructed in the birthplace of Lord Krishna.

"Unless a magnificent temple on the birthplace of Lord Sri Krishna is constructed, I will eat only once a day, beginning today," Mr Dilawar said at a felicitation event in Ramganj Mandi, his constituency in Kota.

In his address, Mr Dilawar recalled how he along with Dr Kirorilal Meena, now a state cabinet minister, and hundreds of kar sevaks staged a demonstration in Ayodhya in 1992 against the illegal detention and fabricated charges of murder against their colleagues.

Mr Dilawar, a six-time MLA and three-time minister, had in February 1990 also vowed he would not accept or wear garland till the Ram Temple is constructed in Ayodhya.

On Monday, after the consecration ceremony was over at Ram Temple in Ayodhya, he was offered a 34 kg garland, and another, 108 feet in length, by his supporters.

Mr Dilawar however refused to wear the garlands saying he would wear it when he visits the temple in Ayodhya on January 31.

In February 1990, Mr Dilwar had also vowed he would not sleep in bed until Article 370 pertaining to Jammu and Kashmir was scrapped. It is said he slept on a mat ever since, till the contentious Article was revoked in 2019, when he finally took to bed.

Ayodhya has been bedecked with multi-coloured flowers; recordings of 'Ram dhun' played from loudspeakers and people dressed as Lord Ram, Sita, Lakshman and Hanuman paraded down the streets.

Ceremonial gates depicting 'Jai Shri Ram' in floral patterns and illumination visible at night add to the aura of the ancient city, which has undergone a massive infrastructural growth in the past couple of years after the 2019 Supreme Court verdict on the Ram temple issue.

"The entire country is chanting the name of Lord Ram," said Uttar Pradesh Deputy Chief Minister Keshav Prasad Maurya.

The portrait will be ready by the end of the day and about 50 kg of colours are being used to make the portrait."

Earlier today, Madhya Pradesh Chief Minister Mohan Yadav flagged off the trucks carrying 5 Lakh Laddus as prasad from the city of Baba Mahakal, Ujjain to Ayodhya for the 'Pran Pratishtha' ceremony of Ram Mandir.

The Chief Minister showed the flag to trucks from Manas Bhawan in the state capital Bhopal on Friday.

Deposit 150 Crores By Jan 31, Supreme Court To New Owners Of Jet Airways

The Supreme Court on Thursday directed Jalan-Kalrock consortium, the new owners of the cash-strapped Jet Airways, to deposit Rs 150 crore in SBI's escrow account by January 31, saying failure to do so will mean that the consortium is not in compliance with the terms of the resolution plan for reviving the airline.

The top court, meanwhile, also refused to allow the separate plea of the Jet Aircraft Maintenance Engineers Welfare Association seeking payment of provident fund and gratuity dues, observing if additional money is awarded, the resolution plan will become “unworkable”.

The consortium, as per the lawyers for the workmen, has to pay over Rs 200 crore towards dues on account of PF and gratuity.

A bench comprising Chief Justice D Y Chandrachud and justices JB Pardiwala and Manoj Misra said the insolvency appellate tribunal NCLAT was not correct in permitting adjustment of Rs 150 crore from the performance bank guarantee (PBG) towards payment of Rs 350 crore by the consortium to the lenders led by the State Bank of India. The amount was to be deposited in SBI's escrow account.

Escrow is a legal concept whereby an asset or money is held by a third party on behalf of two other parties that are in the process of completing a transaction.

"In the circumstances, we have come to the conclusion that the NCLAT (National Company Law Appellate Tribunal) was not justified in holding in its order dated August 28, 2023 that the last tranche of Rs 150 crores, which was to be paid, would be adjusted against the PBG," the bench said.

Out of the Rs 350 crore, which was to be paid by the consortium, Rs 200 crore was deposited in two equal instalments of Rs 100 crore and the remaining Rs 150 crore was adjusted from the performance bank guarantee (PBG) to which lender banks led by the State Bank of India objected.

Under a performance guarantee, monetary compensation has to be paid by the bank when there is any delay in delivering the performance or operation. Payment has to be made even if the service is delivered inadequately.

While referring the case back to the NCLAT for expeditious disposal, the top court said, "The SRA (successful resolution applicant- the Jalan-Kalrock consortium) shall on or before January 31, deposit an amount of Rs 150 crores to the SBI's escrow account failing which the SRA shall be treated as non compliant to the resolution plan." Modifying the August 28, 2023 order of the NCLAT, the bench said the permission granted to the consortium to adjust the last tranche of Rs 150 crore against the PBG is substituted with the direction.

The top court refused to extend the time for deposit of Rs 150 crore from January 31 to February 15 as sought by the consortium.

It said the rights and contentions of rival parties with regard to the compliance of the terms of the resolution plan will be adjudicated upon by the NCLAT.

During the day-long hearing, the bench said the consortium “must restore the performance bank guarantee of Rs 150 crore”.

On Wednesday, the top court had asked the consortium how much have they paid towards provident fund and gratuity dues to the former employees of the troubled airline.

On Thursday, the bench said though it was aware of the plight of the workmen, the amount sought cannot be awarded as it would make the resolution plan to revive the Jet Airways “unworkable”.

On August 28, 2023, the NCLAT had extended till September 30 the time for Jalan-Kalrock consortium to pay Rs 350 crore to the lenders of the bankrupt Jet Airways.

The tribunal had accepted the consortium's plea for extending the deadline and for adjustment of Rs 150 crore from performance bank guarantee (PBG) towards payment of Rs 350 crore.

Jalan-Kalrock Consortium had emerged as the winning bidder for the airline, which stopped flying in April 2019 and later underwent an insolvency resolution process.

Solicitor General Tushar Mehta and Additional Solicitor General N Venkataraman, appearing for the SBI-led consortium of banks which had lent money to Jet Airways, said the financial institutions have to recover Rs 7,800 crore. They said they are also incurring expenses on maintaining aircraft.

A man was arrested for allegedly killing a 34-year-old woman after raping her in this district, police said Wednesday.

The body of the woman was spotted in the hilly area near Bhondsi village on January 13, they said.

Both the accused and the woman were known to each other.

According to police, Jeevan Aharwal (28), a resident of Rajpura village in Madhya Pradesh' Chhatarpur district and the woman, a native of Sagar district, came to know each other when they worked as labourers. The accused, however, later started selling fruits.

A senior police officer said Aharwal confessed to the murder. He told police that he had raped the woman and she wanted to lodge a police complain against him so he killed her by hitting her head with a stone.

"On January 7, he took the woman to the hills of Bhondsi on the pretext of showing her a temple. He raped her and when she resisted and threatened to file a complaint, he killed her using a stone," the official said.

The forest ranger had informed the police on January 13 about the body of a woman lying in the hilly area in Bhondsi. The police reached the spot, took the body in custody, and kept it in the mortuary.

The woman's body was identified a day later by her husband, police said.

An FIR was registered at Bhondsi police station on January 14. During the investigation, a team led by Sub-Inspector Ashok Kumar arrested the accused Jeevan from near SPR Road on Tuesday night, they said.

"We have taken the accused on two days' police remand after producing him in a city court today. We are questioning him," Gurgaon police spokesperson Subhash Boken said on Wednesday.

Doctor, 2 Nurses Off-Rostered After Ventilator Malfunction Kills Patient

A doctor and two nurses of MDM Hospital in Rajasthan's Jodhpur were removed from duty today, a day after a cancer patient died due to a disruption in the supply of oxygen caused by a power shutdown in the trauma centre of the state-run facility.

The action was taken following a preliminary report by the inquiry committee constituted by the hospital administration to fix responsibility for the incident.

Dr Kuldeep Singh and two nurses have been put on APO (awaiting posting order), hospital superintendent Vikas Rajpurohit said, adding that a detailed inquiry was in progress.

A parallel administrative inquiry has been ordered into the incident by the divisional commissioner. Additional District Magistrate Sanjay Basu will conduct the probe and submit a report by Monday.

Rajasthan Medical and Health Minister Gajendra Singh Khimsar reached the hospital this evening and held a meeting.

He enquired about the incident from the hospital superintendent and directed him to take strict action against those responsible for it.

He also directed the administration to take action against the ventilator supplier for the failure of its power backup system.

Gopal Bhati, a cancer patient admitted at the MDM Hospital, died early morning on Friday after the supply of oxygen was disrupted following a power cut, which led to the ventilator dysfunction. An attempt to engage a generator to resume the power supply also failed.

The patient's family alleged that the on-duty doctor was not present at the centre and the male nurse could not handle the situation.

"Had they swung into action and resumed the supply of oxygen by making an alternative arrangement, the patient could have been saved," a family member said.

This is the second such incident at the hospital in nearly 15 years.

In 2011, three patients died due to a disruption in the supply of oxygen.

INDIA Bloc To Hold Talks On Seat-Sharing Tomorrow, Trinamool To Skip Meet

Top leaders of parties of the opposition INDIA bloc will hold discussions on January 13 on strengthening the alliance, chalking out a strategy on seat-sharing, and deciding whether to have a convenor of the grouping, sources said on Friday.

Trinamool Congress leader Mamata Banerjee will not be part of the virtual meeting on Saturday morning as she is preoccupied with prior engagements, they said.

The sources said that discussions would be held on appointing a convenor of the opposition alliance. They added that the JDU wants Nitish Kumar as the convenor which is being opposed by the TMC.

This is the second such attempt to hold a virtual meeting as the previous attempt a few days ago did not materialize, the sources added.

A TMC source said the party was informed about the meeting on Friday evening, and the West Bengal chief minister has some pre-scheduled appointments due to which she may not attend.

The TMC had also offered that the meeting could be held next week. The source added that the party remains committed to the INDIA bloc and defeating the BJP.

As many as 28 opposition parties have come together under the banner of the Indian National Developmental Inclusive Alliance (INDIA) to take on the BJP and defeat it in the 2024 Lok Sabha elections.

However, there are many issues that are yet to be resolved within the alliance, including that of appointing a convenor. Seat-sharing talks with members of the opposition bloc have also not been fruitful so far due to claims and counter-claims on the seats.

The sources said the leaders of the various parties would be meeting to iron out these differences and strengthen the bloc further.

Foreigners Cant Claim Right To Reside, Settle In India: Delhi High Court

The Indian Constitution does not allow a foreign national to claim the right to reside and settle in India, the Delhi High Court has said while observing that the fundamental right of foreigners is limited to the right to life and liberty.

The high court dismissed a petition that claimed the detention of a man named Azal Chakma was illegal and without authority.

"We may also note that foreign national cannot claim that he has the right to reside and settle in India in terms of Article 19 (1) (e) of the Constitution of India.....

"Fundamental right of any such foreigner or suspected foreigner is limited to the one declared under Article 21 of Constitution of India, that is, fundamental right of life and liberty and there is nothing which may suggest that his liberty has been curtailed in an illegal or unlawful manner," a bench of Justices Suresh Kumar Kait and Manoj Jain said.

The high court said Chakma himself is to be blamed for his miseries as he has failed to explain as to how he came back to India when he had left the country on a Bangladeshi passport.

It rejected the habeas corpus petition filed by the family of Azal Chakma, a suspected Bangladeshi national, who was apprehended at the Indira Gandhi International Airport in Delhi in October 2022.

A habeas corpus petition is filed seeking direction to produce a person who is missing or has been illegally detained.

According to the plea, the man has Indian citizenship by birth and had his initial education in Gomati in Tripura and later in Shillong, Meghalaya.

It was averred that he lived in India all his life except for a very brief period and that he was holding an Indian passport, Aadhaar card, PAN card and driving licence issued by Indian authorities, and was running business in Kolkata.

However, Foreign Regional Registration Office (FRRO) contended that the man was apprehended at IGI Airport during immigration clearance when he was attempting to depart for Bangladesh capital Dhaka using a fraudulently obtained Indian passport. It was in this backdrop that his movements were restricted.

The authorities claimed it transpired after scrutiny that Chakma had been visiting India till 2016 on the basis of multiple Indian visas on a passport issued to him by Bangladesh.

They claimed he had left India on a Bangladeshi passport in June 2016 and it was not known how he subsequently sneaked into India.

According to the authorities, he entered India illegally through a porous border and thereafter managed to obtain Indian documents, including passport, in a "fraudulent and dishonest" manner. His passport was revoked by the Indian authorities in June 2023.

The high court was told that Chakma's movements have been restricted under the provisions of the Foreigners Act and that the High Commission of Bangladesh has already issued travel documents for his repatriation. He will be deported as soon as the authorities get a confirmed air ticket for him from the Embassy of Bangladesh, the court was informed.

Child Rights Body Summons YouTube Official Over Indecent Content

The apex child rights body NCPCR on Wednesday summoned an official of YouTube next week over purportedly portrayal of potentially indecent acts involving mothers and sons on its platform.

The National Commission for Protection of Child Rights (NCPCR) has in a notice to the head of government and public policy of YouTube asked him to physically appear on 15 January 15 along with the list of all such channels running on YouTube and the list of channels on YouTube running such content.

The child rights body said it is an alarming trend on YouTube channels where the channels are portraying potentially indecent acts involving mothers and sons.

"This raises serious concerns about the potential harm it could inflict on the child's well-being and safety. Further, these videos have viewership, including minors, which also raises significant concerns," the NCPCR said.

"If you fail to comply with this order without lawful excuse, you will be subjected to the consequences of the non-attendance," the child rights body added.

Aligarh Muslim University Can't Be Minority Institution, Supreme Court Told

Aligarh Muslim University cannot be a minority institution given its "national character", the Centre on Tuesday told the Supreme Court, which began hearing the hugely disputed question of the minority status of AMU.

It said AMU is not and cannot be a university of any particular religion or religious denomination as any university which has been declared an institution of national importance cannot be a minority institution. In his written submissions filed before the apex court, Solicitor General Tushar Mehta said the university has always been an institution of national importance, even in the pre-independence era. The university was founded in 1875.

"Therefore, as per the submission of the Union of India, the Aligarh Muslim University (AMU) is an institution of a national character. A survey of the documents surrounding the establishment of the Aligarh Muslim University and even the then existing legislative position enunciates that the AMU was always an institution having a national character," the document said.

While referring to debates in the Constituent Assembly, it said, it is clear that a university which was and is clearly an institution of national importance, has to be a non-minority university.

"It is submitted that owing to the obviously secular ethos and nature of the nation and the Constitution, considering the fact that AMU is an institution of educational 'national character' it cannot be considered to be a minority institution irrespective of the question whether it was established and administered by the minority at the time of inception or not," Mehta said.

The top law officer said AMU is not a university dominantly functioning as a Muslim university as it is not established and administered by the minority.

"Aligarh Muslim University is not and cannot be a University of any particular religion or religious denomination as any University which is declared by the Constitution of India to be of national importance should, by definition, cannot be a minority institution," Mehta said in his written submissions.

On the impact of declaring AMU as a "minority institution", he said a minority educational institution is not required to implement the reservation policy under section 3 of the Central Educational Institution (Reservation in Admission) Act, 2006 (as amended in 2012).

"Despite being an institution of national importance with other institutes of national importance, Aligarh Muslim University would have a separate admission procedure," the document said.

Mehta said the resultant effect of the said exemption would be "drastic" as AMU is an extremely old and large institute with vast properties and an enormous amount of students studying in various courses.

"It is submitted that a large national institute like Aligarh Muslim University ought to maintain its secular origins and serve the larger interest of the nation first," he said.

Mehta said AMU is ranked ninth among universities and autonomous institutions in India by the Ministry of Education's National Institutional Ranking Framework-2023, and the National Assessment and Accreditation Council (NAAC), an autonomous body of the University Grants Commission, has graded the varsity at 'A '.

"The case of Aligarh Muslim University and Banaras Hindu University is sui generis (unique) case since the framers of the Constitution chose to place these two Universities in List I as a part of Entry 63, though the subject of education is otherwise in the State List (at the time of independence). This exhibits the national character of the University and its stand," it said.

Referring to the AMU Act, the solicitor general said, throughout the process of amendments to the law, the understanding of the character of AMU being national and non-minority has been clear.

"Therefore, the mere omission of the word 'establish' from the preamble and addition of 'established by the Muslims of India' in definition of University section 2(l) of the Aligarh Muslim (University) Act cannot change the historical fact that the Aligarh Muslim University was established by efforts of a large number of people including the State which had no religion and by an Act of the Indian Legislative Council, which did not provide for a predominant minority character to the University," he said.

The issue of AMU's minority status has been caught in a legal maze for the last several decades.

A five-judge constitution bench had in the S Azeez Basha versus Union of India case in 1967 held that since the Aligarh Muslim University was a central university, it cannot be considered a minority institution.

However, the fabled institution established in 1875 got back its minority status when Parliament passed the AMU (Amendment) Act in 1981.

In January 2006, the Allahabad High Court struck down the provision of the 1981 law by which the university was accorded the minority status.

The Congress-led UPA government at the Centre moved in appeal against the Allahabad High Court order. The university also filed a separate petition against it.

The NDA government spearheaded by the BJP told the Supreme Court in 2016 that it will withdraw the appeal filed by the erstwhile UPA dispensation. It had cited the apex court's 1967 judgement in the S Azeez Basha case to claim that AMU was not a minority institution since it was a central university funded by the government.

A seven-judge constitution bench headed by Chief Justice D Y Chandrachud commenced hearing the matter on Tuesday. The arguments remained inconclusive and will resume on Wednesday.

5-Year-Old Youngest In World To Undergo Successful "Awake" Brain Surgery

Doctors at AIIMS, Delhi, successfully performed a brain tumour surgery on a five-year-old girl while keeping her in a conscious state during the operation with the hospital claiming that she was the youngest patient in the world to undergo such a procedure.

The procedure termed as 'awake craniotomy' (conscious sedation technique) surgery for left perisylvian intraaxial brain tumour was performed on January 4, AIIMS said in a statement.

The child presented with a history of seizures and her brain MRI was done which showed a tumour in the left side of her brain adjacent to speech/language area, it said.

The surgery lasted three hours, including time taken for giving local anaesthesia to the child by neuroanaesthetists.

The tumour was removed successfully by a team of neurosurgeons as she remained conscious throughout the procedure.

"Technological adjuncts viz preoperative functional MRI brain, intraoperative ultrasonography, neuronavigation were used to localise tumour precisely during resection while mapping of functional areas was being carried out under awake conditions. Ice cold saline was used for the brain surface to prevent any seizures during the procedure,” the statement said.

“The child is doing well and will be sent home on Monday," it said.

A long discussion was held between team members, patient's family and the child before taking a decision to go ahead with the surgery. They were counselled at length on steps of procedure, it stated.

She was shown common objects, common animals and given some tasks for language and sensorimotor assessments before surgery, which were repeated during the surgical procedure also.

She is a first standard student and was quick in identifying the picture of Prime Minister Narendra Modi during the surgery, the statement said.

"Awake surgeries for brain tumours are done for maximising tumour removals and minimising neurological deficits usually. During awake craniotomy, patients should feel a minimum level of pain while being completely able to cooperate in neurological tests,” it said.

"Although this method is called awake craniotomy, this method requires even more collaboration in perfect harmony of the surgical and anaesthesia teams than other operations under general anaesthesia said,'' Dr Deepak Gupta, Professor of Neurosurgery who performed this operation with his team with neuroanesthesia team led by Dr Mihir Pandia and Dr Gyanendra Pal Singh.

"Akshita happens to be the youngest child in the world to undergo successful brain tumour surgery under awake conditions at this age at AIIMS, Delhi," Dr Gupta said.

Scheme For Delhi Accident Victims Will Be Back Soon, Supreme Court Told

The "Farishtey Dilli Ke" scheme for providing free treatment to accident victims will likely be back on track soon, with the office of the lieutenant governor of Delhi informing the Supreme Court on Friday that the society running it has recently met and decided to release funds for its implementation.

The lawyer appearing for the lieutenant governor's office told the court it was not a "Council of Ministers versus LG" issue.

The counsel termed the case as a "storm in a teacup" and told a bench of Justices B R Gavai and Sandeep Mehta that the LG is not involved in the implementation of the scheme which was governed by a society headed by the city government's health minister.

"You file an affidavit to that effect. If we find that the minister has taken us for a ride, we will impose exemplary cost," the bench told senior advocate Sanjay Jain, appearing for the LG's office.

Jain said, "Nobody has taken anybody for a ride expect that the petitioner has used this court's forum to agitate something… it is a classic case of storm in a teacup".

He told the bench, which was hearing a petition filed by the Delhi government seeking release of funds for the scheme, that it was not a "Council of Ministers versus LG" issue.

"This scheme was governed by a society, and in a recent meeting of the society which has taken place on January 2, they have decided to release the funds from which all pending claims will be issued," Jain said.

The bench said since the funds will be released, it will be the end of the matter.

"Ask the LG not to make every issue a prestige issue," the court observed.

Jain said, "The LG is not involved in this. This is exactly what I wanted to point out. It was a society which is headed by the health minister. It is the health minister only who took the meeting … it is she only who has now released the funds". The senior advocate said he was very surprised that the matter was brought before the court in this manner.

The bench asked him to file an affidavit within two weeks and adjourned the proceedings.

On December 8, the apex court had sought responses from the office of the LG and others on the plea.

Senior advocate Abhishek Singhvi, appearing for the Delhi government, had then submitted that 23,000 road accident victims have been provided cashless treatment in private hospitals under the 'Farishtey Dilli Ke' scheme.

The 'Farishtey Dilli Ke' scheme encourages people to rescue road accident victims. Under the scheme, the government foots hospital bills of those who have met with accidents in the city.

The plea sought immediate re-operationalisation of the scheme by clearing pending bills, releasing timely payment to private hospitals and initiating disciplinary action against officials responsible for deliberately orchestrating the "de-operationalisation" of the scheme.

"Hospitals are now reluctant to accept accident victims and this scheme has practically become defunct for more than a year since payments to the majority of the hospitals have not been made. This has had a catastrophic impact on the medical aid available to victims of road accidents, and lives are being lost on the streets for want of timely and effective treatment...

"Despite repeated reminders and directions by the Department of Health and Family Welfare and the concerned minister regarding clearance of pending bills of the private hospitals, the defaulting officials neither cleared the pending bills nor made timely payments to the private hospitals which have provided cashless treatment to victims of road accidents," the plea said.

Varanasi Court Decision On Making Gyanvapi Survey Report Public Tomorrow

A Varanasi court is likely to give a ruling tomorrow on making the sealed ASI survey report on the Gyanvapi mosque complex public and providing copies of it to the Hindu and Muslim sides.

The court of District Judge AK Vishvesh today said that since the order on the issue has not been typed out yet, it will be given tomorrow, Madan Mohan Yadav, the lawyer for the Hindu side, said.

The counsels of both Hindu and Muslim sides as well as that of the Archeological Survey of India (ASI) were present in court.

The ASI on Wednesday urged the court not to make its report public for at least four more weeks.

The judge could not take up the matter on Thursday as he was busy at an event, his office said. The matter was then posted for Friday.

Following a July 21 order of the district court, the ASI carried out a scientific survey of the Gyanvapi premises, located next to the Kashi Vishwanath temple, to determine whether the mosque was constructed over a pre-existing structure of a Hindu temple.

The survey was ordered by the court after the petitioners claimed the 17th-century mosque was constructed over a pre-existing temple.

On Wednesday, Mr Yadav said the ASI requested the court for four more weeks before the sealed report is opened. The ASI submitted the sealed report to the district court on December 18.

Mr Yadav said the ASI referred to a recent judgment of the Allahabad High Court while urging the court to delay the opening of the report.

The Allahabad High Court on December 19 dismissed several pleas from the Muslim side challenging the maintainability of a suit seeking restoration of a temple where the Gyanvapi mosque now stands.

"The trial in this case of vital national importance should be concluded as soon as possible, preferably within six months. If required, the lower court may direct ASI for a further survey," the High Court observed.

Mr Yadav on Thursday said that the High Court order is likely to be put before Civil Judge Senior Division Fast Track Court of Varanasi on January 19.

The counsel for the ASI, Amit Srivastav, told the judge of the district court on Wednesday that the High Court said in its order that, if necessary, the Civil Judge Senior Division Fast Track Court can order a survey of the Gyanvapi complex once again.

Therefore, if the survey report comes into the public domain now, a situation of contradiction may arise. Therefore, four weeks should be given before the survey report is opened and made available to the parties, the counsel said.

During the hearing in the district court on Wednesday, the Hindu side referred to its application to the Supreme Court seeking permission to clean the mosque 'wazu khana' (used by people for ritual ablutions before offering namaz) as several fish have died there.

The Muslim side objected to this and said the 'wazu khana' was their property and they should be responsible for cleaning it.

The Hindu side told the court that the 'wazu khana' was sealed on the orders of the Supreme Court. They also said that it should be cleaned either by them or the administration.

This matter is also likely to be taken up by the court on Saturday, Mr Yadav said.

Will Survey Report On Gyanvapi Mosque Be Made Public? Court Ruling Today

A Varanasi court is likely to decide Friday on making the sealed ASI survey report on the Gyanvapi mosque complex public and providing copies of it to the Hindu and Muslim sides.

The Archeological Survey of India (ASI) had on Wednesday urged the court not to make its report public for at least four more weeks, according to the lawyer for the Hindu side, Madan Mohan Yadav.

Varanasi district court judge AK Vishvesh then adjourned the matter till Thursday.

However, on Thursday, he could not take up the matter as he was engaged at an event related to Pandit Madan Mohan Malaviya, his office said and added that the matter was then posted for Friday.

Following a July 21 order of the district court, the ASI had carried out the scientific survey of the Gyanvapi premises, located next to the Kashi Vishwanath temple in Varanasi in Uttar Pradesh, to determine whether the mosque was constructed over a pre-existing structure of a Hindu temple.

The survey was ordered by the court after the petitioners claimed the 17th-century mosque was constructed over a pre-existing temple.

On Wednesday, Yadav had said the ASI requested the court for four more weeks before the sealed survey report is opened.

The ASI submitted its survey report to the district court in a sealed cover on December 18.

Yadav said the ASI referred to a recent judgment of the Allahabad High Court while seeking four weeks' time.

The Allahabad High Court had on December 19 dismissed several pleas from the Muslim side challenging the maintainability of a suit seeking restoration of a temple where the Gyanvapi mosque now stands in Varanasi.

In its observation, Justice Rohit Ranjan Agarwal had said the Places of Worship (Special Provisions) Act, 1991, did not define religious character and this can only be determined through evidence presented in the court by opposing parties.

Either the Gyanvapi compound has a Hindu religious character or a Muslim religious character. It can't have dual character at the same time, the judge had said.

"The trial in this case of vital national importance should be concluded as soon as possible, preferably within six months. If required, the lower court may direct ASI for a further survey," the high court had observed.

Yadav on Thursday said that this high court order is likely to be put before Civil Judge Senior Division Fast Track Court of Varanasi on January 19.

The counsel for the ASI, Amit Srivastav, had on Wednesday told the judge of the district court that high court had also said in its order that, if necessary, the Civil Judge Senior Division Fast Track Court can order a survey of the Gyanvapi complex once again.

Therefore, if the survey report comes in the public domain now, a situation of contradiction may arise. Therefore, four weeks' time should be given to open the survey report and make it available to the parties, the counsel had said.

During the hearing in the district court on Wednesday, the Hindu side referred to its application to the Supreme Court seeking permission for cleaning the mosque 'wazu khana' (used by people for ritual ablutions before offering namaz) as several fish have died there.

The Muslim side raised objection to this and said the 'wazu khana' is their property and they should be given the responsibility to clean it.

The Hindu side told the district court that the 'wazu khana' was sealed on the orders of the Supreme Court. The Hindu side also said that it should be cleaned either by them or the administration. The matter is also likely to be taken up by the court on Friday, M M Yadav said.

"Centre Is Not Hostile To Tamil Nadu" On Funds' Flow: Nirmala Sitharaman

The Centre was never hostile towards Tamil Nadu, Kerala or any other state on ensuring funds flow and had made advance payments and even released funds to foster infrastructure development, Union Finance Minister Nirmala Sitharaman said on Thursday.

Responding to a criticism from the DMK government that the central government was not disbursing funds or settling its share, she said from 2014 to 2023 the Centre received Rs 6.23 lakh crore as direct tax (income tax and corporate tax) from Tamil Nadu but gave back Rs 6.96 lakh crore to the state during the same period.

"I will get the update on the current figures only in March. But as per the available statistics, from 2014 till 2022-23, Tamil Nadu's direct tax collection was Rs 6.23 lakh crore. But we gave Rs 6.96 lakh crore to the state," she said while speaking at the Viksit Bharat Sankalp Yatra programme here.

"It is a wrong assumption that this Rs 6.23 lakh crore is paid only by the people of Tamil Nadu. Among them were Hindi-speaking tax assessees," the Finance Minister said.

She had to put the record straight as there has been a misinformation campaign that the BJP-led union government was not prompt in releasing funds to states.

"You are asking to give back your tax money. The Central government has been giving back the Cess, tax or even the GST collected from TN and in addition providing additional funds," Nirmala Sitharaman said.

Post-COVID, going beyond the Finance Commission's recommendations, Prime Minister Narendra Modi had asked her Ministry to provide special capital assistance to the states to foster their infrastructure development, she noted.

The Modi government has settled dues amounting to about Rs 81,645 crore pending since 1996-97 to all states and Tamil Nadu's share in it was Rs 3,225 crore.

The money obtained as cess and surcharge were also given back to the state for the construction of schools and roads, Pradhan Mantri Awas Yojana (Rural) and Gram Sadak Yojana. About Rs 57,557 crore was obtained by way of cess and surcharge from Tamil Nadu from 2014 till date. Of the sum, Rs 37,965 crore was disbursed to construct NHAI roads, Rs 11,116 crore from education cess for Samagra shiksha overarching programme for school education, Rs 4,839 crore for PMAY, Rs 3,637 crore for the rural roads scheme in the state.

Of the Rs 36,353.12 crore collected as GST from Tamil Nadu in 2022-23, the Centre released the entire sum to the state and in addition provided 41 percent from the Rs 27,360 crore CGST collection. "We have given the GST entirely to the state governments without discrimination," she added.

"You are blaming the Centre is not giving funds. The Finance Commission decides on the sum to be given to each state. The Centre is not hostile to Tamil Nadu, Kerala or any state and does not retain the sum due for them. The amount is disbursed on a monthly basis and in certain cases, advance payment is made during festivals," she said.

As the Minister concluded her speech, a woman who had come to attend the function, sought to know if she would get the flood relief sum. Immediately Nirmala  Sitharaman replied "you will get it. We will look into your case if you provide us the details." The Finance Minister handed over cheques to beneficiaries under various central government schemes such as Mudra Yojana, Stand up India, and PM SVANidhi, at the event.

'Officials Should Not Be Summoned As Routine Measure': Supreme Court

Physical presence of government officials in courts may not be necessary, except in judicial proceedings involving recording of evidence, the Supreme Court said on Wednesday in its standard operating procedure meant to regulate the summoning of officials by courts across the country.

The standard operating procedure (SOP) was formulated by a bench comprising Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra in a judgment which came on an appeal of the Uttar Pradesh government.

The Allahabad High Court had ordered the arrest of Secretary (Finance) and the Special Secretary (Finance) of the state for moving an application seeking recall of the order by which the government was asked to notify the rules framed by the chief justice for providing domestic help to retired chief justices and judges of the high court.

"This Standard Operating Procedure is applicable to all court proceedings involving the government in cases before the Supreme Court, High Courts and all other courts acting under their respective appellate and/or original jurisdiction or proceedings related to contempt of court," the judgment said.

The SOP said the presence of the officials may be needed in evidence-based adjudication.

"These proceedings involve evidence such as documents or oral statements. In these proceedings, a government official may be required to be physically present for testimony or to present relevant documents. Rules of procedure, such as the Code of Civil Procedure, 1908, or Criminal Procedure Code 1973, govern these proceedings," the SOP said.

In cases other than evidence recording, the issues can be addressed through affidavits and other documents and physical presence may not be necessary and should not be directed as a routine measure, it said.

"The court should exercise caution and restraint when initiating contempt proceedings, ensuring a judicious and fair process," it said.

"In exceptional cases wherein the in-person appearance of a government official is called for by the court, the court should allow, as a first option, the officer to appear before it through video conferencing," it said.

"The Invitation Link for VC appearance and viewing, as the case may be, must be sent by the Registry of the court to the given mobile no(s)/e-mail id(s) by SMS/email/WhatsApp of the concerned official at least one day before the scheduled hearing," the SOP said.

When the personal presence of an official is directed, reasons should be recorded as to why such presence is required, it said.

"Due notice for in-person appearance, giving sufficient time for such appearance, must be served in advance to the official. This would enable the official to come prepared and render due assistance to the court for proper adjudication of the matter for which they have been summoned," it said.
